The
Litigation group’s involvement begins at the pre-litigation
counseling stage, progresses through the discovery process
and ultimately culminates in trial and, if necessary, the
appellate process. Frequently, however, our clients’
goals are met through negotiated settlement and we strive
toward that end where appropriate. |
Members
of the firm have recently successfully represented clients
before the New York Court of Appeals, as well as in precedent
setting decisions before that Court and the United States
Court of Appeals for the Second Circuit. We have represented
clients before municipal bodies as well as in state and federal
courts. |
Our
attorneys are admitted to practice before the Supreme Court
of the United States, the Southern and Eastern Districts of
the United States District Courts, the Second and Third Circuit
Courts of Appeals, all Courts of the State of New York, and
the Courts of the State of Connecticut. Our attorneys have
been specially admitted in other jurisdictions when our clients’
needs have required that we represent them in such venues. |

extensive appellate practice, appearing before the Appellate
Divisions of the New York State Supreme Court, the Court of
Appeals and before the United States Federal Circuit Courts. |

We represent
a number of financial institutions chartered here in New York
as well as in several other states and foreign countries.
Currently, the firm is handling numerous suits involving defaulted
obligations, foreclosures, loan workouts and lender liability
issues. |

We have an
extensive bankruptcy practice, primarily representing creditors
in Chapter 11 reorganization cases. Our expertise in this
field is often required in connection with commercial, banking,

The firm represents
both individual and business clients in a number of commercial
matters, including U.C.C. issues, leases, breach of warranty,
sales and acquisitions of businesses, computer equipment and
software contracts, and other general business matters. |

The firm’s
practice in this area includes shareholder derivative actions,
corporate deadlocks and minority shareholder oppression matters,
employee contracts, securities issues, and arbitration. |

Election Law Litigation |
| |
Our lawyers come form all walks of life, including involvement in political groups and causes, both in our region and in New York state. New York election law is considered to be the most arcane in the country. Our lawyers have experience in representing political candidates throughout the electoral process, including the petitioning process and challenges to petitions, objections at the Board of Elections dealing with paper ballots (such as affidavit ballots) and litigation as to all such challenges, both at the trial court and appellate court level. |

and Estates attorneys in handling will contests, challenges
to the appointment of fiduciaries and other contested estate
and trust related matters. Much of our practice in this area
has recently been at the appellate level where we have won
favorable decisions from both the Appellate Division of the
New York State Supreme Court and the Court of Appeals. For

and Family Law Litigation |

matters; constitutional issues; and tax review. Our involvement
