In the aftermath of the recent bribery conviction of former state Supreme Court Justice Gerald P. Garson, there has been substantial media coverage of the manner in which matrimonial and family law cases are litigated in the court system, including the role of law guardians, who act as attorneys for the children. Kathleen was interviewed by The Institute for Judicial Studies for Judicial Reports (http://www.judicialreports.com) on this issue. “I’ve found them to be very instrumental for settling cases in matrimonial court,” said Kathleen. She also said that, “[s]ince the Miller Commission there has been an emphasis on the law guardian’s duty to interview the child and communicate the child’s situation to the court." The consideration for the transaction could exceed $36,000,000 (3/07).

was appointed Chair of the Westchester County’s Citizen’s Task Force on Deer Management and Forest Regeneration. The appointment was made by the Westchester County Department of Parks, Recreation and Conservation. (6/06). This new Task Force, amongst other things, is addressing problems of invasive plant species, acid rain, invasive earthworms and diseases killing trees and plants. Bill also serves as Chair of the Westchester County Parks Board.
was relected as a Director to a two year term of Farrel Corp. Farrel Corp., a public company headquartered in Ansonia, Connecticut, designs, manufactures, sells and services state-of-the-art Banbury mixing machines and associated equipment for mixing rubber and plastics. Bill also chairs Farrel’s Compensation Committee and serves on its Audit Committee.

December, 2005 through February, 2006

On December 19, 2005, Joe obtained a $4.5 million settlement in the case of Barilla v. Giangrasso et al., after three weeks of trial in Nassau County Supreme Court. The client, who was 18 years old at the time, suffered multiple injuries when the car in which he was a passenger crashed at high speed into the rear end of a tractor trailer truck which was stopped on the roadway at night. Mr. Barilla's injuries included a severe stretch injury to the brachial plexus, rendering his right arm mostly paralyzed despite surgery, chronic severe pain from a torn nerve root in his neck, and a closed head injury. The settlement was one of the largest ever achieved for such injuries, and one of the largest for a motor vehicle accident in Nassau County in recent years.

As one of the firm's administrative partners, Frank was interviewed by the Westchester County Business Journal on whether legal business for Westchester law firms has been negatively impacted by law firms from New York City or elsewhere that have established offices in Westchester. Frank's comments were reported in the October 31, 2005 issue of the Journal. “I think local firms, like our firm, have entrenched relationships in the business community and it's because of our long-standing and historic reputation that we've established historic relationships. . . . . As for competitiveness, we have a pretty terrific Web site and pride ourselves in being involved in the community and promoting what we do. . . . There are some firms in the city who come here for economic reasons, to get better rent deals than they could get in the city but their practice remains the same. . . . They become a firm in the city that happens to be in a position to continue their New York City work up here.”

As part of the 75th Anniversary celebration of the YWCA of White Plains and Central Westchester, Kathleen was selected and honored as one of Westchester County's outstanding women. The YWCA gives this honor to women who, by their achievements, commitment and leadership, have inspired others while making the community a better place to live and whose actions exemplify the YWCA's mission: to empower women and eliminate racism. To celebrate the YWCA's 75th Anniversary and the award recipients' leadership, a gala was held on November 13, 2004 at the Surf Club in New Rochelle. Gloria Steinem was the guest speaker. The Westchester District Attorney, Jeanine Pirro, was the honorary Chairperson. As a special honorary, Kathleen was inducted into the YWCA Academy.

Tracy J. Dennis
we are pleased to announce that Tracy has returned to our firm as an associate and will continue to practice in the areas of Commercial Finance and Real Estate Transactions (8/1/2004).

As part of her representation of clients who were upset that a lawyer, acting as trustee of a trust fund created for a baby kidnapped from Harlem Hospital in 1987, had not given proper accountings on the trust, Lisa, working with Frank W. Streng, had reviewed the lawyer’s records, identified improper withdrawals from the trust by the lawyer and ultimately forced the lawyer’s resignation as trustee. The lawyer had been the subject of a disciplinary complaint before a Disciplinary Committee of the Appellate Division, First Department. Lisa and the firm fully cooperated in this investigation. Citing Lisa’s investigatory work on the trust, the First Department, having first suspended the lawyer from practice, adopted the recommendation of its Disciplinary Committee and disbarred the lawyer in a decision and order dated August 12, 2004. The case has also been reported by different news publications.

was elected President of Food PATCH. The mission of Food PATCH, a certified affiliate of Second Harvest, the largest domestic hunger relief charity in the United States, is to alleviate hunger and minimize food waste in Westchester County. Food PATCH solicits and administers donations from both the public and private sector, distributing food through local agencies, who, through various programs, meet the needs of individuals and families. participated in the New York City Chapter of the National Multiple Sclerosis Society’s Law Day, which was held in New York City on November 9, 2003. On that occasion John offered his services on a pro bono basis to give legal advice on wills, trusts, powers of attorney and living wills and health care proxies to persons who attended the meeting. Each session with a client lasted one half hour and he offered to prepare documents in situations where they were warranted and requested.

Senator Joe Lieberman Visits Firm
on June 19, 2003, the firm hosted a reception for presidential candidate, Senator Joe Lieberman. Senator Lieberman fielded questions from local attorneys, including lawyers from the firm and members of the Westchester Women's Bar Association. Frank W. Streng, a co-administrative partner of the firm, said: “Our firm was pleased to provide a forum for Senator Lieberman to answer questions and explain his views on domestic and international policies.” According to another partner of the firm, Kathleen Donelli, one such view of the Senator was how the Bush tax cuts would negatively impact on everyone except the very wealthy. Mr. Streng recalls the Senator’s statement that, as a result of the tax cuts, there would be massive budget deficits that both harm the economy and compromise the government’s ability to spend monies on important programs, such as homeland security matters.
